Evidentiary problems can cast the meaning of citizenship into question. In chapter 5, Kim Rubenstein and Jacqueline Field examine the question of what Australian citizenship is when holding the legislatively conferred status of citizen is not. The High Court of Australia in Re Minister for Immigration and Multicultural and Indigenous Affairs; Ex parte Ame (2005) felt compelled to use characterizations that devalued the status of Australian citizenship held by Papuans at the time of Papua New Guinea’s independence. Mr. Ame and his fellow countrymen and countrywomen were “treated as . . . foreigner[s]” to Australia. This practical disjuncture between rights and status, primarily due to conceptions of race and Australian identity and membership at the turn of the century, enabled the court to affirm that as a matter of law someone could hold the legal status of citizen, without any claim to rights associated with that status.
