Jus Soli and Statelessness: A Comparative Perspective from the Americas
In chapter 1, Polly J. Price explores the hidden problem of ineffective citizenship throughout the Americas. Jus soli is endorsed in international agreements as the preferred mechanism to avoid statelessness. But a nearly universal jus soli in the Western Hemisphere often fails to resolve nationality, due to poor documentation of births, government policy and practice, and intentional discrimination. Migrants in the Americas are particularly at risk. Many persons who are entitled to citizenship cannot prove it, or proof is disregarded by officials. Citizenship status, in turn, determines a person’s political, civic, and economic rights. In the United States, the predominant reasons for effective statelessness include the presence of individuals who are unable to prove their nationality, as well as the failure of their countries of origin to recognize them as citizens. Contrary to common assumptions, the elimination of birthright citizenship in the United States would exacerbate statelessness.

The Politics of Evidence: Roma Citizenship Deficits in Europe
In chapter 2, Jacqueline Bhabha provides a case study of the flawed reach of citizenship benefits in the European Union, focusing on Europe’s Roma population, a community long subject to pervasive discrimination and other rights violations. Roma citizenship deficits are described by reference to three types of citizenship—national, regional, and global. Each citizenship status confers entitlements to a distinct set of rights and benefits—residence permits, rights of free movement, refugee protection. The chapter explores the evidentiary obstacles that vitiate proof of entitlement to each citizenship status. It concludes that though the Roma have been in Europe for many centuries, they are routinely treated as illegitimate outsiders, in Europe but not of Europe. The chapter suggests that normative changes and litigation strategies need to be linked to grassroots mobilization within the Roma community itself to correct current flaws in its access to the benefits of citizenship.
